Insurance Coverage and Litigation

We counsel insurance companies on first-party property coverage issues, collaborate with clients’ Special Investigation Units, coordinate outside experts and consultants in scene inspections, take examinations under oath, and represent insurance companies in appraisal and reference proceedings. We also serve as referees and umpires on reference and appraisal panels. We have extensive knowledge and experience in defending bad faith insurance claims.

National Subrogation

Our national subrogation practice offers services covering the first notice of loss all the way through trial, verdict or settlement, and judgment enforcement. We handle large and mid-size losses throughout the United States, utilizing an extensive network of forensic experts, consultants, and trial firms. Our Massachusetts presence allows us to personally handle every aspect of litigation in the state, especially large property losses, with the added advantage of over two decades of local knowledge of the MA legal landscape. Regardless where the loss is located, we work tirelessly to investigate, develop, and litigate each and every claim for a successful outcome.

Insurance Bad Faith Defense

Massachusetts’s General Laws Chapter 93A, §§ 9 and 11 and Chapter 176D §3(9), commonly referred to as “unfair insurance claims practice,” is frequently asserted as a weapon by policyholders against insurance companies in the claims process and in lawsuits. A judicial determination of bad faith claims practice may expose an insurance company to double, treble damages and attorney’s fees. We have time and time again successfully defended insurance companies against bad faith claims practices.

Insurance Fraud Defense

We counsel insurance companies on suspicious claims and prosecute fraud perpetrators in Massachusetts. With the advancement in technology, detection of fraud has become increasingly more difficult, without a knowledgeable insurance fraud lawyer to uncover the facts leading to a success fraud defense. We work with insurance companies’ Special Investigative Unit, forensic engineers, fire investigators, and insurance fraud investigation experts, to uncover hard and soft fraud by policyholder and enterprises. Hard fraud involves some degree of planning and execution. Soft fraud in property insurance claims include exaggeration of the items damaged in a fire and is often referred to as an opportunistic fraud.

Appraisal and Reference

We have over 25 years of experience representing insurance companies and serving as a referee in Massachusetts’s reference proceedings. Most property insurance policies provide for resolution as to the amount of loss through an appraisal process. In Massachusetts, that process is referred to as a reference proceeding. Mass. Gen. Laws ch. 175, § 99, which is incorporated by operation of law into property insurance covering the risk of fire, mandates:
